Thanks to the extraordinary support of our neighbors, West Village Citizens for Preservation is now just $3,000 away from reaching our $32,000 fundraising goal.
The original $25k DOB zoning challenge was fully funded. This new request is to support WVCP’s appeal to the New York City Board of Standards and Appeals (BSA) following DOB’s denial of that challenge.
In response to DOB’s determination, WVCP has filed an appeal arguing that the open space relied upon to support the Mission Building permit was not legally available as required. The underlying facts are substantial and are based on the Church’s own zoning figures and filings.
The timing matters greatly. Our zoning challenge was filed roughly two months before the general construction permit was issued, yet DOB did not respond to the challenge until approximately three weeks after the permit had already been granted. Although DOB is not required to decide a zoning challenge before issuing a permit, the practical effect of that delay is deeply troubling: it deprives concerned neighbors of a meaningful opportunity to challenge a project before construction gains momentum.
The BSA has the authority to review DOB’s determination, reverse it if it was made in error, and revoke a permit that should not have been issued. Demolition activity and construction equipment can create the appearance that the outcome is settled, but it is not. The legal issues remain active, and the current work does not place the project beyond review or remedy.
As with the Community Board process, there will be an opportunity for the public to weigh in before the BSA—whether in person, remotely, or in writing. We expect to have more information soon about the hearing schedule and the ways neighbors can participate.
This is not the time to give up. The Church’s construction activity may feel discouraging, but the appearance of momentum is still tenuous. WVCP’s appeal presents serious unresolved questions about whether the permit was properly issued in the first place.
We are so close. A contribution of any size will help us close the final $3,000 gap and ensure that this appeal is fully supported.
